Terms and Conditions of Bidding

Please READ ALL of the Terms & Conditions Carefully Before bidding as by bidding you are entering into a legally binding contract: 

•  Forms of Payment: Personal or Business Checks, Money Orders, Certified Bank Checks, Credit/Debit Cards (Paid ONLINE only), ACH, or Wire Transfer. Any Returned checks will require a $40 returned check fee. If the buyer wishes to pay by Credit Card there will be an additional special administration fee excessed of 3% to account for labor, convenience, and time involved.
• The Credit Card used during the registration process is used to verify your identity to prevent false registrations.  However, by agreeing to these terms, you agree that this card is saved on file. If you fail to make payment on your invoice, Rich & Rich Auctioneers reserves the right to charge your credit card on file for the purchases plus any applicable fees.
• No Items will be released from the auction site without a valid paid invoice. NO EXCEPTIONS. Invoices will be emailed to buyers after a sale has been completed and you can also find your invoice under your profile settings in the bidder’s platform (starting Sept. 2026).
• Nonpayment will result in buyers being suspended from the Rich and Rich bidders’ system permanently and legal action will be taken. Bidders are legally responsible for their bid and payment of invoices.
• Items are to be paid in full and picked up from the auction location in 3 days and/or the last scheduled date of check-out. After this time, the property will be considered forfeited and abandoned. Rich and Rich is not responsible for items after this date and is not responsible for loading.
• Sales Tax is required for all buyers that do not have appropriate tax exemption information. This includes equipment sales tax as well as sales tax on the 3% internet convenience fee. All states have their own tax exemption rules, and buyers are responsible for having all necessary tax exemption paperwork for the appropriate state.
• We DO NOT charge Buyer's Premiums; however, we do charge a convenience fee for access and providing online bidding capabilities through Nextlot. This pays for the use of the services they provide and to have a skilled operator on site to ensure that the technology is properly utilized and answers buyers’ technical problems if any.
• All Title Vehicles will require a $25 title fee. Titles will be mailed (Certified Mail) and have a processing time of at least 14 days before they will be mailed out. If you would like to pick up your title before that time frame, you can come to our office and personally pick up your title. Please call beforehand to make sure the title has arrived in the office from the auction site.
• Sellers are required to have titles at the time of equipment listing and contract signing. The title must be free of liens, in the seller’s name, and in the seller’s hand. No title vehicles will be taken without valid titles. If you are selling a vehicle without a title, it will be listed as: NOT BEING SOLD FOR ROAD USE, BEING SOLD FOR SCRAP ONLY. 
• Sellers are responsible for maintaining their own reserves on equipment.
• All items are sold “AS-IS, WHERE IS”. YOU ARE BUYING AN ITEM AS IS WITH NO WARRANTY, EXPRESSED OR IMPLIED. ALL SALES ARE FINAL WITH NO RETURNS. WE RECOMMEND EXAMINING THE ITEMS IN-PERSON BEFORE BIDDING.
• Buyer is responsible for the inspection of equipment. There is no warranty expressed, written, or implied, and Rich and Rich Auctioneers are not responsible for seller descriptions. The buyer is responsible for his/her decision to purchase equipment with no inspection and is legally liable for his/her bid. Announcements made on the day of the sale take precedence over any and all printed materials. Buyers are responsible for inspecting equipment prior to the auction and cannot hold the auction company liable for descriptions made without the buyers prior viewing. All Sales are Held Rain or Shine!! Loading is provided as a convenience to our buyers and auction company cannot be held responsible for damage caused to personal property during loading. 
• We do not have a shipping department; the buyer is responsible for transport of the equipment purchased. However, we will make every effort to help direct you in finding shipping and/or a shipping company to accommodate your needs for the items you purchase.
• Rich and Rich reserves the right to reject a bid for any reason, cancel an auction, change the date of an auction or remove a lot prior to the closing of the auction even if a bid has been placed.
• Rich and Rich is not responsible for the buyers bidding. It is the bidder’s responsibility to keep up with the bids he/she is placing. Make sure to pay careful attention to the time frame allowed for bidding. Some bids are done by automatic bidding when a bidder places a maximum bid in the system. Rich and Rich Auctioneers is not responsible if the buyer is outbid. 
• Bidders are responsible for reading Information lots on each auction. Information varies by auction and includes important information regarding each individual auction. These lots serve as additional terms and conditions of bidding on that specific auction.
• By registering to bid or by using the permanent number to which you have been assigned, the buyer agrees to adhere to all terms and conditions set within this brochure and any terms to which may be stated by public announcement on the day of the auction.
